IMPOTENT LAWS

Our Country has exhaustive laws. But is anyone there getting justice?. What use is of laws that cannot protect the innocent?.

Our courts have pending cases dating back several years. What is being done to clear the cases?. Over and above this, if one does not seem to get justice in the lower courts, he can appeal to higher and higher courts, thus demeaning the worth of the lower courts. With so many pending cases, why this should be allowed?.

What is the use if a case comes up for trials after so many years?. Justice delayed is justice denied.

Are the genuine cases tried and verdict given?. Whatever it is, the common man does not get justice. for eg. if an employer dispenses his employee without assigning any reason, the employee is advised not to approach the court because it will ultimately spoil his career. He is advised to gradually forget and carry on. Is this justice?. If a shopkeeper charges more than the label listed price, the consumer is advised to compromise and not take up the issue. Our so called consumer courts do precisely this. People who cheat and swindle with the investment of hard earned money are not caught and tried.

Criminals, Murderers, convicts, Rapists and the corrupt are let out on bail and finally go scot free because of their 'connections'.  The law is soft on landgrabbers, illlegal miners and producers of illicit liquor. No cases are registered against careless drivers from Government owned transport buses even if they kill, let alone their traffic offences.  What about Poachers, Doctors' negligence etc..?.

What is the quality of our lawyers?. Can the common man afford a lawyer?. Does it not happen that  the lawyers take the people for a ride by promising the moon and giving handful of sand after charging for it?. Who has to ensure this?. Is not the Government responsible?

In short, our law can punish the genuine but helpless against the real offenders. Common people can only trust God for divine justice. No wonder, in the land of Godmen, people can draw some solace.

COMMON INJUSTICE

Every month when a common man receives his pay cheque from his office, the Government has already taken a part of your income as Income Tax. After 15 months, the common man has to file his Income tax returns with the Government begging them to take a reasonable amount and return the balance, usually 75-80% of the amount Government has already taken from him. After this, The Government takes its own sweet time to refund that money to the concerned person. So Government takes ones money before 30 months and still thinks whether to return it to him. What an injustice?.Why are we Indians put to such hardships?. And then there are rules which are one way, favorable to the Government, inimical to the common man.

Likewise, all payments to Government such as Road Tax, Property Tax, Excise & Customs Duty, Sales Tax, Service Tax and other types of taxes are collected in advance.After payment of all these, still the common man does not get anything in return.

Collecting service tax for such services like telephone calls, Insurance premium payments, hospital bills, educational tutorial fees are nothing but absurd.

Railway ministry cannot provide a train ticket to the common man to travel in peace. He is charged exhorbitant premium amount in the form of Tatkal booking to provide him a seat. The booking agents take advantage of this and with or without the connivance of the Railway staff make hay. The irony of it, common man is slapped with a bigger tatkal bill to keep out the touts ( they say!!!). 

But in the Parliament, the ministers help themselves to largesse with no encumberances. They have huge salaries, free perks and power to earn more.

EDUCATION IN SHAMBLES

It is the duty of the Government to provide education to the children either free of cost or at a nominal fee. But, strangely, in our country, the business of Education has been given to the private people without any check on its functioning. In actuality, our Government is going against the Constitution, which it is supposed to safeguard.

The trouble starts right from primary education. For LKG admission, parents queue up in front of private schools from night onwards. This is sweet news to private schools who start counting money by the size of the queue. While the student progresses in school, there is hardly any control on the exorbitant fees charged by the school, the facilities and the infrastructure provided, the quality of teaching and training. With the result, it is a great burden on the parents and as is with every department of the Government, they do not get quality in return, on the contrary, they are harassed. The private schools are run by Industry houses that act as a safe tax haven for them, NGOs which run the schools on a profit because they are not provided with Government funds. There are only a few institutions which run schools with a good intention but with no support from the Government. Another vague area is the presence of several Boards such as CBSE, ICSE, State Boards, Matriculation etc. How can a uniform education be provided?.

Come to higher Education which is a murkier scene. Colleges are started and run by politicians who have no background in education. In the name of Premier Institutions, Minority Institutions, Reservation of seats, Aided and Non-aided Universities, Autonomous and Attached Universities, the confusion is complete. Rather than the talent of a student is identified and developed, it has become a tool for some to harass common people and make money. In the name of Premier Institute, they are allowed to charge fantastic amount which cannot be afforded by the majority of its people. This has made the Rich and the Powerful to turn the system to their advantage thereby churning out sub-standard graduates. Capitation fees, price for a Medical or Engineering seat are making a mincemeat of the whole system.  The aim of the students who are graduating from such a system can only breed corruption. There are prices for graduate to get job in a police, postal, Electricity, Hospitals, Research Institutions run by government departments. What would be goal and the caliber of such people?.

What is more?. Such a system is aided and abetted by the State and the Central Governments.  Did the framers of our Constitutions expect such a situation when they drafted it?. Just as every other sphere of activity in our country, Education too has been twisted out of proportions. A sad state of affairs indeed!.
